Please read these Terms and Conditions carefully before using the WebAct Service. These terms explain customer responsibilities, billing, design work, hosting, marketing, widgets, acceptable use, and legal conditions.

These Terms and Conditions govern access to and use of the WebAct Service and form the agreement between the user and WebAct.
You represent that you are over the age of 18. WebAct does not permit those under 18 to use the Service.
Use of the Service is also subject to WebAct's Privacy Policy, which explains how personal information is collected, used, and disclosed.
Capitalized words have meanings defined in the Terms. These definitions apply whether they appear in singular or plural form.

The individual accessing or using the Service, or the company or legal entity on whose behalf the individual is accessing or using the Service.
Services or content provided by a third party that is displayed, included, made available, or linked through the Service.
These Terms and Conditions govern use of the Service and set out the rights and obligations of users. Access to and use of the Service is conditioned on acceptance of and compliance with these Terms. If you disagree with any part of the Terms, you may not access the Service.
You represent that you are over the age of 18. WebAct does not permit those under 18 to use the Service.
The Service may contain links to third-party websites or services that are not owned or controlled by WebAct. WebAct has no control over and assumes no responsibility for third-party content, privacy policies, terms, practices, goods, or services. Your use of third-party websites, social media services, or tools is governed by those third parties' terms and privacy policies.
These terms apply to website design, graphic design, first drafts, deposits, scope, publishing, and domain setup.
Any design project quoted under $300 must be paid in full before the project begins.
Any design project quoted at $300 or more is paid in a 50/50 split: 50% at the beginning and 50% upon completion.
Upon acceptance and payment of a quote, you agree to the terms outlined in the Terms and Conditions.
Once payment is received, WebAct begins working on the project. First drafts are typically completed within 25 business days unless otherwise stated.
If WebAct has started work and there is no contact, the project may take longer than expected.
Once WebAct has worked on a website design project, the deposit is non-refundable.
After the first draft is complete, WebAct sends a preview by email for review of design quality, content accuracy, and desired functionality.
Once the project is finalized, the final payment is collected. WebAct then sends image files for graphic design projects or assists with publishing website projects.
If the scope changes after the original quote, such as adding pages, the remaining payment may be adjusted accordingly.
Websites designed by WebAct require a hosting subscription with WebAct. WebAct typically does not design websites on WordPress, Drupal, or custom HTML.
To make a website live, WebAct may need Advanced DNS Settings or Domain Zone File access. If the domain is not with WebAct, WebAct may request registrar login access or provide setup instructions.
WebAct's website builder is a cloud-based multi-screen platform for creating, maintaining, and supporting websites.
Website content cannot promote, conduct, or contribute to fraudulent, obscene, pornographic, spammy, deceptive, defamatory, inappropriate, or illegal activities.
The platform cannot be used solely for file sharing copyrighted or uncopyrighted material.
The platform is cloud-hosted and does not provide FTP access. Content must be uploaded or modified through the builder.
WebAct is not responsible for the accuracy, usefulness, safety, or intellectual property rights of website content.
WebAct makes no guarantee that having a website will generate traffic, rank first on Google, or increase revenue.
Subscription payments must remain current. If payment fails and is not updated after notices, the website may be deactivated.
$50 per month or $450 per year.
$100 per month or $900 per year for up to 2,500 products.
Once a website is live, customers have access to make content changes at no additional cost.
Minor changes are $25 per change. Major changes are $100 per change. Additional pages with customer-provided content are $150 per page on an existing site.
If you no longer want WebAct hosting and want to keep your current website, WebAct may move your website to your own Duda account. Websites on other platforms may not be transferable or copied to another hosting provider.

These terms apply to PPC advertising, SEO campaigns, landing pages, reporting, account control, cancellation, refunds, and ad spend.
PPC campaigns may include creating landing pages geared toward top-selling products or local areas.
SEO campaigns may include monitoring keywords and creating landing pages to improve organic search engine visibility.
WebAct can generate more website traffic through marketing campaigns, but does not guarantee first-place Google rankings, more contacts, or increased revenue.
Once SEO or digital advertising services have started, there are no refunds, credits, or partial refunds under any circumstances.
WebAct customers with PPC or SEO campaigns are sent monthly analytics and ROI reports.
Advertising cancellation requires 30 days' notice. Customers may not take control over advertising accounts or ads created by WebAct.
WebAct is not responsible for Google or Microsoft ad spending accounts and does not compensate for platform ad spending for any reason.
These terms apply when purchasing WebAct widgets, custom widgets, and custom coding.
When you purchase a widget, you are buying it for your account and cannot transfer it to another account.
You are not permitted to resell WebAct widgets.
You may add to or change a widget, but WebAct will not fix the widget if it breaks from your modifications.
WebAct does not offer refunds on widget purchases because widgets cannot always be removed from an account.
Custom widget or custom coding payments are non-refundable if you back out after payment, because custom work requires research and planning.
If you purchase a widget and need modifications, WebAct will provide a proposal. Payment is required before modification work starts.
WebAct reserves the right to terminate business with customers who treat staff with disrespect, including verbal or written abuse.
WebAct operates under the governing laws of Colorado in the United States.
Terms and conditions are subject to change. If material changes are made, WebAct will make reasonable efforts to provide at least 30 days' notice before new terms take effect.
If WebAct has completed work and charges are disputed, the account may be subject to collections or small claims court, and active services may be turned off until the account is paid in full plus disputed charge fees.
If payment is not made, the account may be paused until payment is made in full.
If you have concerns or disputes about the Service, you agree to first try to resolve them informally by contacting WebAct.
European Union consumers benefit from mandatory provisions of the law of the country in which they reside.
You represent that you are not located in an embargoed or restricted country and are not listed on a United States government prohibited or restricted party list.
If any provision is unenforceable or invalid, it will be interpreted to accomplish its objective as much as possible, and remaining provisions continue in effect.
Failure to exercise a right or require performance does not waive future rights or obligations.
If the Terms are translated, the original English text prevails in case of dispute.
WebAct may terminate or suspend access immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, the right to use the Service ceases immediately.
To the maximum extent permitted by law, WebAct and its suppliers are not liable for special, incidental, indirect, or consequential damages. The Service is provided "AS IS" and "AS AVAILABLE" without warranty of any kind. Some jurisdictions do not allow certain exclusions or limitations, so some limitations may not apply and will be applied to the greatest extent enforceable.
